This massive assembly, <strong>marking a rocky start to the presidency of William Lai <\/strong>(Lai Ching-te; \u8cf4\u6e05\u5fb7) who was inaugurated the day before after winning an unprecedented third consecutive term for the ruling Democratic Progressive Party (DPP), was a response to a <strong>brawl<\/strong> which erupted in the chamber the previous week as the DPP accused the KMT and the TPP of attempting to force through the proposals while forgoing the customary consultation process.<\/p><p><strong>The protests focus on the contents of the proposed amendments to the Law Governing the Legislative Yuan\u2019s Power<\/strong> (\u7acb\u6cd5\u9662\u8077\u6b0a\u884c\u4f7f\u6cd5) and the process in which the opposition parties (which together hold a majority in the legislature) have sought to promulgate them. <strong>The reforms would grant new prosecutorial powers to legislators<\/strong> who could summon private individuals, government officials, and others to question and demand that they disclose sensitive information, including documents with implications for national security. The DPP and protestors also criticized the opposition parties for blocking matching bills compiled by the DPP from being reviewed at committee meetings, conducting backroom dealings, and <strong>resorting to nontransparent voting procedures.<\/strong><\/p><h2>\u00a0<\/h2><h2>What is the broader picture?<\/h2><p>In the January 2024 elections, the Democratic Progressive Party achieved a historic third consecutive victory in the presidential race while also losing control of the legislature. With 52 seats won by the KMT and 51 secured by Lai\u2019s Democratic Progressive Party (DPP), neither of Taiwan\u2019s two major parties gained an absolute majority in the unicameral legislature, positioning the relatively new TPP with its eight legislators as the \u201c<a href=\"https:\/\/www.cna.com.tw\/news\/aipl\/202401130369.aspx?topic=3695\" target=\"_blank\" rel=\"noopener\">critical minority<\/a>\u201d (\u95dc\u9375\u5c11\u6578).\u00a0<\/p><p><strong>Reforms to grant the Legislative Yuan more power were a critical issue in the electoral campaign.<\/strong> All three parties represented in the chamber expressed their willingness to amend the legislature&#8217;s powers and procedures, but they <strong>disagreed on the scope of the changes. <\/strong><\/p><p>The ongoing controversy surrounds <strong>three main changes<\/strong> proposed by the KMT and the TPP. Firstly, the <strong>president would be required to deliver an annual address<\/strong> before March 1 at the Legislature&#8217;s invitation and respond to lawmakers&#8217; questions on the spot. Secondly, the <strong>legislature would gain prosecutorial powers,<\/strong> and penalties would be introduced for delays in responding to the parliament, concealing information, or providing false statements during an investigation, inquiry, or hearing. Thirdly, <strong>&#8220;contempt of the legislature&#8221; would become an offense punishable<\/strong> under the Criminal Code. Those critical of the current trajectory of reforms also point to procedural issues as the bills were not reviewed line by line in the Judiciary and Organic Laws and Statutes Committee.<\/p><p>\u201cThey [KMT and TPP] further surpass the scope and power of parliamentary authority found in most other constitutional democracies, including allowing for government officials to be jailed simply for asking questions during hearings,\u201d the DPP said in a <a href=\"https:\/\/focustaiwan.tw\/politics\/202405210014\" target=\"_blank\" rel=\"noopener\">statement<\/a> signed by international scholars.<\/p><p>Taiwan\u2019s civil society groups also remain vocal about criticizing the reforms proposed by the two opposition parties. The Taiwan Association of Human Rights <a href=\"https:\/\/chngthengteng.wordpress.com\/2024\/05\/20\/opposition-to-the-tyranny-of-the-majority-that-destroys-democracy\/?fbclid=IwZXh0bgNhZW0CMTAAAR2RJG4MsRMLU0RjPHCAtbnAOJDb-yuV8tXhSAmcNKZBpQjtKTmZ5Z1_rO4_aem_AZZExlKiaPP8gZNBx6ZZkDqGFCt9eDP31WDj0sL3W5Es8-dliyF2S9KdpoCZ8vw1-IgTdAStKBHUz4TkSe_7ofBs\" target=\"_blank\" rel=\"noopener\">asserted<\/a> that the amendments would \u201c<strong>effectively result in the legislative branch overstepping into executive functions,<\/strong> violating the fundamental principle of separation of powers in a democratic society.\u201d Meanwhile, the Taiwan Bar Association <a href=\"https:\/\/www.taipeitimes.com\/News\/front\/archives\/2024\/05\/20\/2003818112\" target=\"_blank\" rel=\"noopener\">accused<\/a> the KMT of \u201cwrecking the operating principles of Taiwan\u2019s constitutional democracy\u201d to pursue its own interests. It also urged lawmakers to abide by democratic principles and follow legislative procedures to ensure that bills receive legitimate scrutiny.\u00a0<\/p><p>Protests will resume on Friday when the legislature will continue the debates about amendments to its powers.<\/p><h2>\u00a0<\/h2><h2>Why does it matter?<\/h2><p>The conflict between the legislature, where the KMT and the TPP combined hold the majority of seats, and the executive <strong>may lead to a gridlock<\/strong> in Taiwan&#8217;s policy-making and implementation processes during the next four years. In his inauguration speech, Lai <a href=\"https:\/\/focustaiwan.tw\/politics\/202405200007\" target=\"_blank\" rel=\"noopener\">addressed<\/a> the need for cohabitation: \u201cThe majority should respect the minority, while the minority accepts majority rule. Only then can we avoid conflict and maintain a stable and harmonious society.\u201d At the same time, the Taiwanese political scene remains highly polarized, and prospects for streamlined inter-party policy coordination remain grim.<\/p><p>Additionally, watchers of cross-strait relations have previously pointed to <strong>the Legislative Yuan as a potential channel for China to exert its influence on Taiwan<\/strong> and its democratic institutions and processes. For example, exiled Chinese writer Hongbin Yuan (\u8881\u7d05\u51b0) <a href=\"https:\/\/news.ltn.com.tw\/news\/politics\/breakingnews\/4681195\" target=\"_blank\" rel=\"noopener\">asserted<\/a> that Legislative Yuan speaker Han Kuo-yu (\u97d3\u570b\u745c) and the majority leader Fu Kun-chi (\u5085\u5d10\u8401) remain influenced by the United Front Work Department of the Chinese Communist Party. Consequently, the current controversy highlights the importance of scrutinizing Taiwanese politicians&#8217; relations with political elites on the opposite side of the Taiwan Strait.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Protests in the streets of Taipei, Photo by Su Chiao-hui Protesty v ulic\u00edch Tchaj-peje, foto: Su Chiao-hui What is happening?
