Attracting close to <a href=\"https:\/\/twitter.com\/ginollopez\/status\/1733744153572618670\" target=\"_blank\" rel=\"noopener\">2000 participants<\/a>, the biennial rally drew attention to the <strong>discriminatory treatment<\/strong> of the 751 thousand-strong community of <strong>migrant workers<\/strong> in Taiwan, which remains<strong> a major human rights issue<\/strong> in Taiwan and a source of concern for the country\u2019s democratic partners, including the <a href=\"https:\/\/chinaobservers.eu\/normative-power-taiwan-human-rights-and-taiwan-eu-relations\/\" target=\"_blank\" rel=\"noopener\">European Union<\/a>. The specific focus of this year\u2019s march was the call to<strong> abolish private labor brokers<\/strong> and agencies who charge employees exuberant fees and engage in exploitative behavior, including<strong> debt bondage<\/strong>, without providing the necessary services. Labor activists have <a href=\"https:\/\/www.taipeitimes.com\/News\/taiwan\/archives\/2023\/07\/30\/2003803971\" target=\"_blank\" rel=\"noopener\">described<\/a> the migrant worker private brokerage system as \u201c<strong>modern slavery.<\/strong>\u201d<\/p><h2>What is the broader picture?<\/h2><p>Since it began its transition to democracy in late 1980s, Taiwan developed a<strong> vibrant and democratic political system<\/strong> with a robust system of <strong>protections for civil liberties<\/strong>. Despite its exclusion from the United Nations system, Taiwan successfully incorporated the <strong>International Covenant on Civil and Political Rights<\/strong> and the <strong>International Covenant on Economic, Social and Cultural Rights<\/strong> into its domestic law and installed a local model of the <strong>international review process<\/strong>.<\/p><p>Yet, Taiwan\u2019s <strong>migrant labor force<\/strong>, hailing predominantly from Vietnam, Indonesia, the Philippines, and Thailand, continues to face <a href=\"https:\/\/thediplomat.com\/2021\/12\/addressing-challenges-faced-by-taiwans-migrant-workers\/\" target=\"_blank\" rel=\"noopener\"><strong>discriminatory treatment<\/strong><\/a> which <a href=\"https:\/\/ketagalanmedia.com\/2021\/06\/17\/covid-19-migrant-workers-and-the-fight-for-equality-in-taiwan\/\" target=\"_blank\" rel=\"noopener\">intensified<\/a> during the <a href=\"https:\/\/www.equaltimes.org\/taiwan-s-foreign-factory-workers#.Y9OUQnZBy5d\" target=\"_blank\" rel=\"noopener\">COVID-19 pandemic<\/a>. Often undertaking undesirable \u201c3D\u201d (<strong>dirty, dangerous, and difficult<\/strong>) jobs, migrant workers fill in gaps in labor supply in critical industries, from <a href=\"https:\/\/taiwaninsight.org\/2022\/10\/21\/the-interaction-between-taiwans-indigenous-and-migrant-workers-taking-the-construction-industry-as-an-example\/\" target=\"_blank\" rel=\"noopener\">construction<\/a> and <a href=\"https:\/\/asia.nikkei.com\/Business\/Tech\/Semiconductors\/Taiwan-s-army-of-migrant-workers-keep-its-chip-economy-running\" target=\"_blank\" rel=\"noopener\">manufacturing<\/a> to domestic and institutional <a href=\"https:\/\/comparativemigrationstudies.springeropen.com\/articles\/10.1186\/s40878-022-00311-2\" target=\"_blank\" rel=\"noopener\">eldercare<\/a>.<\/p><p>The situation of the migrant workers remains a <strong>critical issue<\/strong> for the EU and the US government. One of the key concerns highlighted in the 2021 EU Annual Human Rights Report is Taiwan\u2019s failure to integrate the International Labor Organization\u2019s (ILO) <strong>C188 Work in Fishing Convention<\/strong> into domestic law. The convention, which came into force internationally in November 2017, safeguards <strong>fishers\u2019 right<\/strong> to <strong>decent conditions of work<\/strong> on board fishing vessels. The Taiwan 2022 Human Rights Report published by the American Institute in Taiwan also highlights the issues of <strong>forced labor<\/strong>, <strong>debt bondage<\/strong>, <strong>abuse <\/strong>faced by migrant fisherfolk, and <strong>excessive work hours <\/strong>violating the general work conditions of foreign workers.<\/p><p>Speaking at the rally on Human Rights Day, an Indonesian labor representative elaborated on the links between the private broker system and limitations in access to civil rights which the migrant community continues to face. \u201cIn case of sexual harassment at work, violent treatment, or workplace accidents,<strong> it is useless to ask for help from an agent<\/strong>, who will either tell [the worker] to be patient or to go back to Indonesia; or if they are lucky enough to have the opportunity to change employers, the agent will <strong>force them to pay<\/strong> for the purchase of a job,\u201d she said.<\/p><p>In response to the organizers of the rally, the Workforce Development Agency (WDA) under the Ministry of Labor said in a statement that the current channels for hiring migrant workers were \u201cdiverse\u201d and \u201callowed employers to choose based on their needs\u201d. This involves either <strong>directly hiring migrant workers<\/strong> from their home countries through the government-run Direct Hiring Service Center or <strong>relying on brokers<\/strong> for the hiring process, the agency said. <em>Focus Taiwan, <\/em>the English-language platform of Taiwan\u2019s Central News Agency, also <a href=\"https:\/\/focustaiwan.tw\/politics\/202312100010\" target=\"_blank\" rel=\"noopener\">emphasizes<\/a> that WDA announced initiatives to <strong>improve the management and oversight of brokers<\/strong> to address the problem of excessive fees, yet did not provide a specific timeline or content of this scheme.<\/p><h2>Why does it matter?<\/h2><p>Given the confluence of normative, legal, and economic ramifications of human rights violations on the Taiwanese distant water fleet and in the manufacturing sector, enhanced EU action on this issue is currently highly opportune. The <a href=\"https:\/\/focustaiwan.tw\/politics\/202212200005\" target=\"_blank\" rel=\"noopener\">European Parliament <\/a>and the <a href=\"https:\/\/www.reuters.com\/world\/taiwan-seeks-quick-progress-long-stalled-eu-investment-deal-2022-12-20\/\" target=\"_blank\" rel=\"noopener\">Taiwanese government<\/a> are urging the European Commission to accelerate the work on the Bilateral Investment Agreement (BIA). As a \u201c<a href=\"https:\/\/www.princeton.edu\/~amoravcs\/library\/mannersnormativepower.pdf\" target=\"_blank\" rel=\"noopener\">normative power<\/a>\u201d or an ideational actor <a href=\"https:\/\/www.europarl.europa.eu\/cmsdata\/86031\/Study.pdf\" target=\"_blank\" rel=\"noopener\">seeking<\/a> to harmonize international economic regulation with its fundamental rights regime, the EU <a href=\"https:\/\/www.europarl.europa.eu\/cmsdata\/86031\/Study.pdf\" target=\"_blank\" rel=\"noopener\">promotes<\/a> human rights clauses in its investment and trade agreements.
