Smlouvy o fungov\u00e1n\u00ed Evropsk\u00e9 unie (SFEU).<\/li>\n<li>Za \u00fa\u010delem vybudov\u00e1n\u00ed prostoru svobody, bezpe\u010dnosti a pr\u00e1va byl v\u00a0roce 2009 p\u0159ijat Stockholmsk\u00fd program stanovuj\u00edc\u00ed c\u00edle a priority Evropsk\u00e9 unie (EU).<\/li>\n<li>T\u00e9mata obsa\u017een\u00e1 ve\u00a0Stockholmsk\u00e9m programu zahrnuj\u00ed harmonizaci v\u00a0oblasti trestn\u00edho a ob\u010dansk\u00e9ho pr\u00e1va s\u00a0p\u0159eshrani\u010dn\u00edm prvkem, boj s\u00a0organizovan\u00fdm zlo\u010dinem a terorismem, v\u00edzovou politiku a ochranu vn\u011bj\u0161\u00edch hranic, dobudov\u00e1n\u00ed azylov\u00e9ho syst\u00e9mu a spole\u010dnou p\u0159ist\u011bhovaleckou politiku.<\/li>\n<li>Program byl p\u011btilet\u00fd a jeho platnost vypr\u0161\u00ed koncem roku 2014, Evropsk\u00e1 rada na z\u00e1klad\u011b \u010dl. 68 SFEU p\u0159ijme na sv\u00e9m \u010dervnov\u00e9m zased\u00e1n\u00ed strategick\u00e9 sm\u011bry pro legislativn\u00ed a operativn\u00ed pl\u00e1nov\u00e1n\u00ed nahrazuj\u00edc\u00ed Stockholmsk\u00fd program pro dal\u0161\u00ed obdob\u00ed.<\/li>\n<li>Evropsk\u00e1 rada bude muset na sv\u00e9m zased\u00e1n\u00ed zhodnotit dosavadn\u00ed v\u00fdvoj v\u00a0oblasti a definovat kl\u00ed\u010dov\u00e1 t\u00e9mata pro budoucnost.<\/li>\n<li>D\u016fraz by m\u011bl b\u00fdt kladen sp\u00ed\u0161e na implementaci a prosazov\u00e1n\u00ed st\u00e1vaj\u00edc\u00edch p\u0159edpis\u016f ne\u017e na tvorbu nov\u00e9 legislativy.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\">1. Pozad\u00ed<\/h2>\n<p style=\"text-align: justify;\">Lisabonsk\u00e1 smlouva, kter\u00e1 vstoupila v\u00a0platnost v\u00a0roce 2009, znamenala konec pil\u00ed\u0159ovit\u00e9 struktury EU, kter\u00e1 vznikla v\u00a0roce 1993 po p\u0159ijet\u00ed Maastrichtsk\u00e9 smlouvy. T\u0159et\u00ed pil\u00ed\u0159, nazvan\u00fd p\u016fvodn\u011b Oblast spravedlnosti a vnit\u0159n\u00edch v\u011bc\u00ed (Justice and Home Affairs \/ JHA), byl v\u00a0roce 1999 v\u00a0r\u00e1mci Amsterdamsk\u00e9 smlouvy z\u00fa\u017een a p\u0159ejmenov\u00e1n na Policejn\u00ed a justi\u010dn\u00ed spolupr\u00e1ci v trestn\u00edch v\u011bcech. Politiky t\u00fdkaj\u00edc\u00ed se azylu, p\u0159ist\u011bhovalectv\u00ed a justi\u010dn\u00ed spolupr\u00e1ce v\u00a0civiln\u00edch v\u011bcech byly p\u0159esunuty do prvn\u00edho pil\u00ed\u0159e (Evropsk\u00e9 spole\u010denstv\u00ed), kde podl\u00e9haly komunit\u00e1rn\u00edmu re\u017eimu. V\u00a0r\u00e1mci t\u0159et\u00edho pil\u00ed\u0159e nem\u011bly unijn\u00ed instituce pravomoc p\u0159ij\u00edmat rozhodnut\u00ed a o politik\u00e1ch rozhodovaly \u010dlensk\u00e9 st\u00e1ty v\u00a0r\u00e1mci mezivl\u00e1dn\u00ed spolupr\u00e1ce. V roce 2009 t\u0159et\u00ed pil\u00ed\u0159 zaniknul a oblasti v n\u011bm obsa\u017een\u00e9, spolu s\u00a0n\u011bkter\u00fdmi oblastmi z\u00a0prvn\u00edho pil\u00ed\u0159e, byly nov\u011b upraveny v\u00a0Hlav\u011b\u00a0V.\u00a0Smlouvy o fungov\u00e1n\u00ed Evropsk\u00e9 unie (SFEU) nazvan\u00e9 Prostor svobody, bezpe\u010dnosti a pr\u00e1va (Area of Freedom, Security and Justice \/ AFSJ). Lisabonsk\u00e1 smlouva dala unijn\u00edm instituc\u00edm pravomoc jednat a p\u0159ij\u00edmat rozhodnut\u00ed i v\u00a0t\u00e9to oblasti.<\/p>\n<figure id=\"attachment_3537\" aria-describedby=\"caption-attachment-3537\" style=\"width: 523px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.evropskehodnoty.cz\/wp-content\/uploads\/2014\/06\/image_AA.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-3537\" alt=\"image_AA\" src=\"https:\/\/www.evropskehodnoty.cz\/wp-content\/uploads\/2014\/06\/image_AA.jpg\" width=\"523\" height=\"340\" \/><\/a><figcaption id=\"caption-attachment-3537\" class=\"wp-caption-text\">Zdroj: https:\/\/ec.europa.eu\/avservices<\/figcaption><\/figure>\n<p style=\"text-align: justify;\">Z\u00e1kladn\u00edm \u010dl\u00e1nkem pro tuto oblast je \u010dl. 67 (SFEU), kter\u00fd stanov\u00ed, \u017ee \u201eUnie tvo\u0159\u00ed prostor svobody, bezpe\u010dnosti a pr\u00e1va p\u0159i respektov\u00e1n\u00ed z\u00e1kladn\u00edch pr\u00e1v a r\u016fzn\u00fdch pr\u00e1vn\u00edch syst\u00e9m\u016f a tradic \u010dlensk\u00fdch st\u00e1t\u016f\u201c. Jeho c\u00edlem je umo\u017enit voln\u00fd pohyb osob a z\u00e1rove\u0148 zajistit vysokou \u00farove\u0148 ochrany ob\u010dan\u016fm Unie. Rozsah politik spadaj\u00edc\u00edch do oblasti AFSJ je velmi rozs\u00e1hl\u00fd \u2013 pat\u0159\u00ed sem imigra\u010dn\u00ed a azylov\u00e1 politika, oblast policejn\u00ed a justi\u010dn\u00ed spolupr\u00e1ce, ochrana vn\u011bj\u0161\u00edch hranic i boj proti organizovan\u00e9 p\u0159eshrani\u010dn\u00ed trestn\u00e9 \u010dinnosti. Dal\u0161\u00edmi podstatn\u00fdmi \u010dl\u00e1nky pro prostor svobody, bezpe\u010dnosti a pr\u00e1va jsou \u010dl. 16 SFEU, t\u00fdkaj\u00edc\u00ed se ochrany osobn\u00edch \u00fadaj\u016f, a \u010dl\u00e1nky 18 a\u017e 25, pojedn\u00e1vaj\u00edc\u00ed o z\u00e1kazu diskriminace a ob\u010danstv\u00ed Unie.<\/p>\n<p style=\"text-align: justify;\">Prostor svobody, bezpe\u010dnosti a pr\u00e1va je pro \u010dlensk\u00e9 st\u00e1ty velmi citlivou z\u00e1le\u017eitost\u00ed a jeho v\u00fdjime\u010dnost oproti jin\u00fdm politik\u00e1m EU se prom\u00edtla i na upraven\u00ed zp\u016fsobu, jak\u00fdm \u010dlensk\u00e9 st\u00e1ty mohou napadnout legislativn\u00ed n\u00e1vrhy v\u00a0t\u00e9to oblasti. Zat\u00edmco u ostatn\u00edch politik sta\u010d\u00ed, aby podn\u011bt dala jedna t\u0159etina \u010dlen\u016f n\u00e1rodn\u00edch parlament\u016f podle kl\u00ed\u010de uveden\u00e9ho v\u00a0Protokolu \u010d. 2, tak u AFSJ byl tento po\u017eadavek sn\u00ed\u017een na jednu \u010dtvrtinu. T\u00edm byla n\u00e1rodn\u00edm parlament\u016fm umo\u017en\u011bna snaz\u0161\u00ed kontrola p\u0159ij\u00edman\u00e9 legislativy.<\/p>\n<p style=\"text-align: justify;\">Odli\u0161n\u011b byl upraven prostor svobody, bezpe\u010dnosti a pr\u00e1va i v\u00a0p\u0159\u00edpad\u011b rozhodov\u00e1n\u00ed Soudn\u00edho dvora Evropsk\u00e9 unie. A\u017e do prosince 2014 plat\u00ed v\u00a0p\u0159\u00edpad\u011b AFSJ v\u00fdjimka pro rozhodov\u00e1n\u00ed o p\u0159edb\u011b\u017en\u00fdch ot\u00e1zk\u00e1ch. S\u00a0koncem prosince 2014 ale skon\u010d\u00ed p\u0159echodn\u00e1 f\u00e1ze, AFSJ p\u0159ejde pod standardn\u00ed re\u017eim a soudn\u00ed kontrola prov\u00e1d\u011bn\u00e1 Evropsk\u00fdm soudn\u00edm dvorem se nebude v\u00a0ni\u010dem li\u0161it od kontroly ostatn\u00edch politik Evropsk\u00e9 unie.<\/p>\n<h2 style=\"text-align: justify;\">2.\u00a0 Historie<\/h2>\n<p style=\"text-align: justify;\">Prvn\u00ed kroky v\u00a0oblasti dne\u0161n\u00edho prostoru svobody, bezpe\u010dnosti a pr\u00e1va byly u\u010din\u011bny ji\u017e v\u00a070. letech 20.\u00a0stolet\u00ed, ale po\u010d\u00e1tek hlub\u0161\u00ed spolupr\u00e1ce p\u0159i\u0161el a\u017e s\u00a0ustanoven\u00edm schengensk\u00e9ho prostoru na za\u010d\u00e1tku 90.\u00a0let, kter\u00fd umo\u017enil z\u00e1sadn\u00ed v\u00fdvoj v\u00a0oblasti spravedlnosti a vnit\u0159n\u00edch v\u011bc\u00ed. Maastrichtsk\u00e1 smlouva, platn\u00e1 od roku 1993, ustanovila oblast spolupr\u00e1ce a vnit\u0159n\u00edch v\u011bc\u00ed jako t\u0159et\u00ed pil\u00ed\u0159 v\u00a0takzvan\u00e9 pil\u00ed\u0159ovit\u00e9 struktu\u0159e EU. Jednalo se o mezivl\u00e1dn\u00ed prvek, v\u00a0jeho\u017e r\u00e1mci m\u011bly unijn\u00ed org\u00e1ny jen velmi omezen\u00e9 pravomoci. Amsterdamsk\u00e1 smlouva z\u00a0roku 1999 znamenala p\u0159enesen\u00ed \u010d\u00e1sti b\u00fdval\u00e9ho t\u0159et\u00edho pil\u00ed\u0159e do pil\u00ed\u0159e prvn\u00edho \u2013 komunit\u00e1rn\u00edho. Sou\u010dasn\u011b byla poprv\u00e9 <a href=\"https:\/\/www.europarl.europa.eu\/summits\/tam_en.htm\">na zased\u00e1n\u00ed Evropsk\u00e9 rady v Tampere<\/a> p\u0159edstavena idea prostoru svobody, bezpe\u010dnosti a pr\u00e1va. \u00a0O deset let pozd\u011bji, v\u00a0roce 2009, byla pil\u00ed\u0159ovit\u00e1 struktura Lisabonskou smlouvou zru\u0161ena a d\u0159\u00edve rozd\u011bln\u00e1 oblast byla op\u011bt spojena pod n\u00e1zvem prostor svobody, bezpe\u010dnosti a pr\u00e1va.<\/p>\n<p><a href=\"https:\/\/www.evropskehodnoty.cz\/wp-content\/uploads\/2014\/06\/ASFJ_final.pdf\"><img decoding=\"async\" class=\"wp-image-3506 aligncenter\" alt=\"ASFJ_Cover\" src=\"https:\/\/www.evropskehodnoty.cz\/wp-content\/uploads\/2014\/06\/ASFJ_Cover.jpg\" width=\"391\" height=\"557\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">V\u00a0n\u00e1vaznosti na jednotliv\u00e9 smlouvy p\u0159ij\u00edmali z\u00e1stupci vl\u00e1d \u010dlensk\u00fdch st\u00e1t\u016f programy usiluj\u00edc\u00ed o stanoven\u00ed konkr\u00e9tn\u00edch c\u00edl\u016f ve v\u00fd\u0161e zm\u00edn\u011bn\u00fdch oblastech. Jednalo se o program z\u00a0finsk\u00e9ho Tampere, p\u0159ijat\u00fd roku 1999, a n\u00e1sledn\u011b o Haagsk\u00fd program z roku 2004, kter\u00fd stanovil c\u00edle pro obdob\u00ed v letech 2005\u20132010. V\u00a0n\u00e1vaznosti na Lisabonskou smlouvu byl p\u0159ijat Stockholmsk\u00fd program zab\u00fdvaj\u00edc\u00ed se z\u00e1sadami pro obdob\u00ed 2010\u20132014. Komise p\u0159ijala v\u00a0dan\u00e9 oblasti Ak\u010dn\u00ed pl\u00e1n, kter\u00fd se zab\u00fdval prov\u00e1d\u011bn\u00edm programu. Platnost obou dokument\u016f vypr\u0161\u00ed letos v\u00a0prosinci a p\u0159edsedov\u00e9 vl\u00e1d a hlavy \u010dlensk\u00fdch st\u00e1t\u016f budou jednat na zased\u00e1n\u00ed Evropsk\u00e9 rady v\u00a0\u010dervenci 2014 o nov\u00e9m dokumentu, kter\u00fd by stanovil c\u00edle EU na dal\u0161\u00ed obdob\u00ed.<\/p>\n<h2 style=\"text-align: justify;\">3. Sou\u010dasn\u00fd stav<\/h2>\n<p style=\"text-align: justify;\">Jak ji\u017e bylo \u0159e\u010deno, v\u00a0leto\u0161n\u00edm roce kon\u010d\u00ed obdob\u00ed, pro kter\u00e9 byl p\u0159ijat Stockholmsk\u00fd program. Po prosinci 2014 nebude existovat \u017e\u00e1dn\u00fd dokument, kter\u00fd by stanovil c\u00edle v\u00a0oblasti prostoru svobody, bezpe\u010dnosti a pr\u00e1va. V\u00a0sou\u010dasn\u00e9 dob\u011b prob\u00edh\u00e1 diskuse o dokumentu, kter\u00fd by m\u011bla Evropsk\u00e1 rada p\u0159ijmout na sv\u00e9m zased\u00e1n\u00ed v\u00a0\u010dervnu tohoto roku a kter\u00fd by m\u011bl nav\u00e1zat na Stockholmsk\u00fd program. Nej\u010dast\u011bj\u0161\u00ed ot\u00e1zky t\u00e9to diskuse se t\u00fdkaj\u00ed nejen obsahu, ale i formy. Na rozd\u00edl od p\u0159ede\u0161l\u00fdch let toti\u017e nebude Evropsk\u00e1 rada p\u0159ij\u00edmat podrobn\u00fd program, ale \u201estrategick\u00e9 sm\u011bry pro legislativn\u00ed a operativn\u00ed pl\u00e1nov\u00e1n\u00ed\u201c (\u010dl. 68 SFEU).<\/p>\n<p style=\"text-align: justify;\">Stockholmsk\u00fd program je pom\u011brn\u011b rozs\u00e1hl\u00fd dokument, kter\u00fd podrobn\u011b rozpracov\u00e1v\u00e1 vizi evropsk\u00fdch politik\u016f pro AFSJ. Neobsahuje pouze c\u00edle, ale stanovuje program legislativy a konkr\u00e9tn\u00edch krok\u016f v\u00a0jednotliv\u00fdch \u010d\u00e1stech t\u00e9to oblasti. Z\u00e1kladn\u00edmi komponenty AFSJ, a tedy i Stockholmsk\u00e9ho programu, jsou spole\u010dn\u00e1 v\u00edzov\u00e1, azylov\u00e1 a p\u0159ist\u011bhovaleck\u00e1 politika, soudn\u00ed spolupr\u00e1ce ve v\u011bcech ob\u010danskopr\u00e1vn\u00edch, obchodn\u00edch a rodinn\u00fdch a policejn\u00ed a soudn\u00ed spolupr\u00e1ce ve v\u011bcech trestn\u00edch.<\/p>\n<p style=\"text-align: justify;\">Podle <a href=\"https:\/\/europa.eu\/rapid\/press-release_MEMO-14-174_en.htm\">zpr\u00e1vy Komise<\/a> bylo od roku 2010 napln\u011bno 95 % Stockholmsk\u00e9ho programu s\u00a0pomoc\u00ed v\u00edce ne\u017e 50 iniciativ. Bylo ji\u017e p\u0159ijato velk\u00e9 mno\u017estv\u00ed legislativn\u00edch akt\u016f, kter\u00e9 napl\u0148uj\u00ed p\u0159ev\u00e1\u017enou v\u011bt\u0161inu ze stanoven\u00fdch c\u00edl\u016f. Tato bohat\u00e1 legislativn\u00ed \u010dinnost, zalo\u017een\u00e1 na Stockholmsk\u00e9m programu, dala vzniknout pevn\u00e9mu z\u00e1kladu pro prostor svobody, bezpe\u010dnosti a pr\u00e1va.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.evropskehodnoty.cz\/wp-content\/uploads\/2014\/06\/tab_01.jpg\"><img decoding=\"async\" class=\"wp-image-3538 alignnone\" alt=\"tab_01\" src=\"https:\/\/www.evropskehodnoty.cz\/wp-content\/uploads\/2014\/06\/tab_01-1024x635.jpg\" width=\"638\" height=\"396\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">P\u0159esto se ale d\u00e1 zp\u011btn\u011b identifikovat n\u011bkolik mezer v\u00a0Stockholmsk\u00e9m programu, kter\u00e9 jsou p\u0159ev\u00e1\u017en\u011b spojeny s\u00a0v\u00fdzvami souvisej\u00edc\u00edmi s\u00a0ud\u00e1lostmi posledn\u00edch n\u011bkolika let. Jedn\u00e1 se nap\u0159\u00edklad o ot\u00e1zky po\u010d\u00edta\u010dov\u00e9 kriminality nebo stability v\u00a0regionu severn\u00ed Afriky a Bl\u00edzk\u00e9ho v\u00fdchodu v\u00a0souvislosti s\u00a0ud\u00e1lostmi Arabsk\u00e9ho jara. Pr\u00e1v\u011b vlna revoluc\u00ed v\u00a0arabsk\u00fdch zem\u00edch uk\u00e1zala, \u017ee Unie postr\u00e1d\u00e1 \u00fa\u010dinn\u00fd mechanismus, kter\u00fd by mohl v\u00a0r\u00e1mci AFSJ (nap\u0159. v ot\u00e1zce neleg\u00e1ln\u00edho p\u0159ist\u011bhovalectv\u00ed) \u00fasp\u011b\u0161n\u011b reagovat na ne\u010dekan\u00e9 ud\u00e1losti.<\/p>\n<p style=\"text-align: justify;\">Vzhledem k\u00a0citliv\u00e9 povaze prostoru svobody, bezpe\u010dnosti a pr\u00e1va se n\u011bkter\u00e9 \u010dlensk\u00e9 st\u00e1ty rozhodly ne\u00fa\u010dastnit se pln\u011b na rozhodnut\u00edch p\u0159ijat\u00fdch v\u00a0t\u00e9to oblasti. V\u00fdjimky si vyjednali Spojen\u00e9 kr\u00e1lovstv\u00ed, Irsko a D\u00e1nsko, pro kter\u00e9 plat\u00ed odchyln\u00fd re\u017eim. Mohou se ne\u00fa\u010dastnit legislativn\u00edch proces\u016f a p\u0159ijat\u00e1 opat\u0159en\u00ed na n\u011b nebudou m\u00edt vliv. <a href=\"https:\/\/europa.eu\/legislation_summaries\/institutional_affairs\/treaties\/lisbon_treaty\/ai0022_cs.htm\">V\u00fdjimky jsou dvou druh\u016f<\/a> \u2013 tzv. opt-in a opt-out. V\u00a0p\u0159\u00edpad\u011b opt-in maj\u00ed st\u00e1ty mo\u017enost p\u0159ijmout v\u00a0jednotliv\u00fdch p\u0159\u00edpadech projedn\u00e1van\u00e9 opat\u0159en\u00ed nebo aplikovat opat\u0159en\u00ed ji\u017e d\u0159\u00edve p\u0159ijat\u00e9. Naopak nepou\u017eit\u00ed konkr\u00e9tn\u00edho opat\u0159en\u00ed se naz\u00fdv\u00e1 opt-out.<\/p>\n<h2 style=\"text-align: justify;\">4.\u00a0 Co se bude d\u00edt po roce 2014<\/h2>\n<p style=\"text-align: justify;\">A\u010dkoliv bude chronologicky nov\u00fd dokument navazovat na sou\u010dasn\u00fd Stockholmsk\u00fd program, bude se s\u00a0velkou pravd\u011bpodobnost\u00ed v\u00a0mnoha form\u00e1ln\u00edch i obsahov\u00fdch ohledech li\u0161it. Smlouva o fungov\u00e1n\u00ed Evropsk\u00e9 unie mluv\u00ed o \u201estrategick\u00fdch sm\u011brech\u201c, nikoliv o programu, a nov\u00fd dokument se tak bude podobat sp\u00ed\u0161e star\u0161\u00edmu dokumentu z\u00a0Tampere (1999) ne\u017e nov\u011bj\u0161\u00edm program\u016fm \u2013 Haagsk\u00e9mu a Stockholmsk\u00e9mu.<\/p>\n<h3 style=\"text-align: justify;\"><strong>a. Forma<\/strong><\/h3>\n<p style=\"text-align: justify;\">V\u00a0SFEU chyb\u00ed \u010dasov\u00e9 ohrani\u010den\u00ed pro nov\u011b p\u0159ijat\u00e9 strategick\u00e9 sm\u011bry. Nab\u00edz\u00ed se tak n\u011bkolik mo\u017enost\u00ed. S\u00a0ohledem na p\u0159edch\u00e1zej\u00edc\u00ed p\u011btilet\u00e9 programy bude mo\u017en\u00e9 nastavit platnost nov\u00e9ho dokumentu znovu na p\u011bt let. Z\u00a0praktick\u00fdch d\u016fvod\u016f by se ale nab\u00edzelo i \u0159e\u0161en\u00ed sedmilet\u00e9, kter\u00e9 by reflektovalo d\u00e9lku v\u00edcelet\u00e9ho rozpo\u010dtov\u00e9ho r\u00e1mce EU. Podle prim\u00e1rn\u00edho pr\u00e1va je minim\u00e1ln\u00ed d\u00e9lka v\u00edcelet\u00e9ho finan\u010dn\u00edho r\u00e1mce p\u011bt let (\u010dl. 312 SFEU), posledn\u00ed v\u00edcelet\u00fd finan\u010dn\u00ed r\u00e1mec byl p\u0159ijat na obdob\u00ed 2007\u20132013 a <a href=\"https:\/\/ec.europa.eu\/budget\/index_en.cfm\">sou\u010dasn\u00fd<\/a> plat\u00ed pro obdob\u00ed 2014\u20132020. Sjednotit obdob\u00ed nov\u00e9ho programu s\u00a0rozpo\u010dtov\u00fdm obdob\u00edm by mohlo pomoci jednodu\u0161\u0161\u00ed administraci a pl\u00e1nov\u00e1n\u00ed konkr\u00e9tn\u00edch legislativn\u00edch krok\u016f.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.evropskehodnoty.cz\/wp-content\/uploads\/2014\/06\/tab_02.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-3539 alignnone\" alt=\"tab_02\" src=\"https:\/\/www.evropskehodnoty.cz\/wp-content\/uploads\/2014\/06\/tab_02-1024x654.jpg\" width=\"655\" height=\"418\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">Ot\u00e1zkou z\u016fst\u00e1v\u00e1, jak\u00fd vliv by mohly m\u00edt na rozhodov\u00e1n\u00ed nest\u00e1tn\u00ed org\u00e1ny, jak\u00fdmi jsou neziskov\u00e9 organizace, nebo ob\u010dansk\u00e1 spole\u010dnost. Evropsk\u00e1 unie vynakl\u00e1d\u00e1 snahu zapojit tyto akt\u00e9ry do rozhodovac\u00edho procesu, nap\u0159\u00edklad DG pro Spravedlnost po\u0159\u00e1dalo na podzim 2013 <a href=\"https:\/\/ec.europa.eu\/justice\/events\/assises-justice-2013\/index_en.htm\">odborn\u00e9 f\u00f3rum Assises de la Justice<\/a> zab\u00fdvaj\u00edc\u00ed se budoucnost\u00ed evropsk\u00fdch politik spravedlnosti, nicm\u00e9n\u011b p\u0159\u00edm\u00fd vliv t\u011bchto organizac\u00ed a odborn\u00e9 ve\u0159ejnosti z\u016fst\u00e1v\u00e1 nejasn\u00fd.<\/p>\n<h3 style=\"text-align: justify;\"><strong>b. Obsah<\/strong><\/h3>\n<p style=\"text-align: justify;\">I kdy\u017e se hlavy \u010dlensk\u00fdch st\u00e1t\u016f dohodnou na form\u011b, kterou by m\u011bly strategick\u00e9 sm\u011bry dostat, dal\u0161\u00ed ot\u00e1zkou bude obsah dokumentu. Shodnout se budou muset na t\u00e9matech i na obecn\u00e9m sm\u011b\u0159ov\u00e1n\u00ed. Bude to poprv\u00e9 co p\u0159ijet\u00ed z\u00e1sadn\u00edho dokumentu v\u00a0prostoru svobody, bezpe\u010dnosti a pr\u00e1va nebude spojeno s \u017e\u00e1dnou zm\u011bnou prim\u00e1rn\u00edho pr\u00e1va a Evropsk\u00e1 rada tak bude moci reagovat na dosavadn\u00ed v\u00fdvoj a nast\u00ednit budouc\u00ed sm\u011b\u0159ov\u00e1n\u00ed, ani\u017e by musela reflektovat zm\u011bny ve Smlouv\u00e1ch.<\/p>\n<p style=\"text-align: justify;\">Vzhledem ke\u00a0skute\u010dnosti, \u017ee Evropsk\u00e1 rada bude reagovat na ji\u017e zaveden\u00fd program a funguj\u00edc\u00ed evropskou politiku, m\u011bl by b\u00fdt v\u011bt\u0161\u00ed d\u016fraz kladen na efektivn\u00ed implementaci pravidel a prosazov\u00e1n\u00ed pr\u00e1vn\u00edch p\u0159edpis\u016f. Nen\u00ed t\u0159eba vytv\u00e1\u0159et zcela nov\u00fd program, m\u011blo by se sp\u00ed\u0161e stav\u011bt na sou\u010dasn\u00e9m stavu. Na v\u00fdznamu tohoto postupu se shodli r\u016fzn\u00ed akt\u00e9\u0159i v\u00a0oblasti evropsk\u00fdch politik, od Komise po odbornou ve\u0159ejnost. Je t\u0159eba rozli\u0161ovat mezi implementac\u00ed st\u00e1vaj\u00edc\u00edch pravidel a mezi legislativn\u00edm m\u00f3dem a p\u0159ij\u00edm\u00e1n\u00edm nov\u00fdch p\u0159edpis\u016f.<\/p>\n<p style=\"text-align: justify;\">Mezi nov\u00e1 t\u00e9mata, kter\u00e1 v\u00a0posledn\u00edch letech vystupuj\u00ed jako podstatn\u00e1 sou\u010d\u00e1st prostoru svobody, bezpe\u010dnosti a pr\u00e1va, pat\u0159\u00ed bezesporu v\u00fdzvy spojen\u00e9 s\u00a0finan\u010dn\u00ed kriz\u00ed, vn\u011bj\u0161\u00ed politikou a stabilitou v\u00a0regionu a ochranou osobn\u00edch \u00fadaj\u016f. \u00dasporn\u00e1 opat\u0159en\u00ed \u010dlensk\u00fdch st\u00e1t\u016f reaguj\u00edc\u00ed na finan\u010dn\u00ed krizi budou m\u00edt dlouhodob\u00fd vliv na schopnost st\u00e1t\u016f implementovat po\u017eadavky stanoven\u00e9 Evropskou uni\u00ed. A\u010dkoliv tato skute\u010dnost nem\u016f\u017ee m\u00edt za\u00a0n\u00e1sledek sn\u00ed\u017een\u00ed standard\u016f, je nutn\u00e9 ji akceptovat a p\u0159izp\u016fsobit se j\u00ed.<\/p>\n<p style=\"text-align: justify;\">Po\u010d\u00edta\u010dov\u00e1 trestn\u00e1 \u010dinnost se st\u00e1v\u00e1 st\u00e1le nal\u00e9hav\u011bj\u0161\u00edm probl\u00e9mem, na kter\u00fd mus\u00ed EU naj\u00edt \u00fasp\u011b\u0161nou odpov\u011b\u010f. Vzhledem ke sv\u00e9 specifick\u00e9 povaze si \u017e\u00e1d\u00e1 i zvl\u00e1\u0161tn\u00ed p\u0159\u00edstup, kter\u00fd <a href=\"https:\/\/europa.eu\/rapid\/press-release_IP-14-233_cs.htm\">zahrnuje<\/a> mezin\u00e1rodn\u00ed spolupr\u00e1ci a partnerstv\u00ed mezi ve\u0159ejn\u00fdm a soukrom\u00fdm sektorem. I v\u00a0t\u00e9to oblasti je kl\u00ed\u010dov\u00e1 p\u0159edev\u0161\u00edm implementace st\u00e1vaj\u00edc\u00ed strategie a uveden\u00ed p\u0159ijat\u00fdch pravidel do praxe. Nov\u00e9 strategick\u00e9 sm\u011bry by m\u011bly nav\u00e1zat na dosavadn\u00ed \u00fasp\u011bchy, jak\u00fdm je nap\u0159\u00edklad zalo\u017een\u00ed Evropsk\u00e9ho centra pro boj proti kyberkriminalit\u011b, a prohlubovat boj proti kyberzlo\u010dinu na \u00farovni \u010dlensk\u00fdch st\u00e1t\u016f i v\u00a0r\u00e1mci jejich spolupr\u00e1ce. Reagovat mus\u00ed Evropsk\u00e1 rada i na situaci v\u00a0regionu. Je pot\u0159eba v\u011bt\u0161\u00ed integrace mezi vnit\u0159n\u00edmi a vn\u011bj\u0161\u00edmi politikami EU pro zaji\u0161t\u011bn\u00ed stability, bezpe\u010dnosti a spravedlnosti ve t\u0159et\u00edch zem\u00edch, p\u0159edev\u0161\u00edm pak v\u00a0zem\u00edch soused\u00edc\u00edch s\u00a0EU a zem\u00edch Bl\u00edzk\u00e9ho v\u00fdchodu a severn\u00ed Afriky. S\u00a0t\u00edm souvis\u00ed i ot\u00e1zka spolupr\u00e1ce civiln\u00edho a vojensk\u00e9ho sektoru, kterou <a href=\"https:\/\/ec.europa.eu\/dgs\/home-affairs\/what-we-do\/policies\/future-of-home-affairs\/high-conference-jan-2014\/docs\/den_boer_en.pdf\">by m\u011bla EU prohlubovat<\/a>, pokud chce p\u016fsobit jako z\u00e1ruka bezpe\u010dnosti v\u00a0regionu.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.evropskehodnoty.cz\/wp-content\/uploads\/2014\/06\/tab_03.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-3536 alignnone\" alt=\"tab_03\" src=\"https:\/\/www.evropskehodnoty.cz\/wp-content\/uploads\/2014\/06\/tab_03-1024x432.jpg\" width=\"655\" height=\"277\" \/><\/a><\/p>\n<p style=\"text-align: justify;\"><strong>Kl\u00ed\u010dov\u00e9 body<\/strong><\/p>\n<p style=\"text-align: justify;\">Komise identifikovala v\u00a0oblasti vnit\u0159n\u00edch v\u011bc\u00ed n\u00e1sleduj\u00edc\u00ed probl\u00e9my \u2013 zvy\u0161uj\u00edc\u00ed se mezin\u00e1rodn\u00ed mobilitu, demografick\u00e9 zm\u011bny, nedostatky na trhu pr\u00e1ce, nestabilitu v\u00a0zem\u00edch soused\u00edc\u00edch s\u00a0EU, prudk\u00fd v\u00fdvoj v\u00a0modern\u00edch technologi\u00edch a ekonomick\u00e9 z\u00e1jmy Unie. Jako z\u00e1sadn\u00ed v\u00fdzvy pro budoucnost vid\u00ed otev\u0159enost Unie, t\u00fdkaj\u00edc\u00ed se mobility a migrace, a bezpe\u010dnost, charakterizovanou bojem proti po\u010d\u00edta\u010dov\u00e9 trestn\u00e9 \u010dinnosti, obchodu s\u00a0lidmi, p\u0159eshrani\u010dn\u00edmu organizovan\u00e9mu zlo\u010dinu a terorismu. V\u00a0oblasti spravedlnosti Komise mluv\u00ed o problematice d\u016fv\u011bry v\u00a0oblasti soudnictv\u00ed, mobility ob\u010dan\u016f EU a ekonomick\u00e9ho r\u016fstu.<\/p>\n<p style=\"text-align: justify;\">Kl\u00ed\u010dov\u00e1 t\u00e9mata, kter\u00fdm by se m\u011bla Evropsk\u00e1 rada v\u011bnovat, \u00fazce souvis\u00ed se sou\u010dasnou ekonomickou a politickou situac\u00ed. V\u00a0oblasti p\u0159ist\u011bhovaleck\u00e9 politiky se jedn\u00e1 o podporu mobility kvalifikovan\u00fdch pracovn\u00edk\u016f, zaji\u0161t\u011bn\u00ed dialogu s \u010dlensk\u00fdmi st\u00e1ty, podniky a\u00a0odbory ohledn\u011b popt\u00e1vky po migruj\u00edc\u00edch pracovn\u00edc\u00edch a usnadn\u011bn\u00ed uzn\u00e1v\u00e1n\u00ed kvalifikac\u00ed a odbornosti. Spole\u010dn\u00e1 azylov\u00e1 politika by se m\u011bla i nad\u00e1le prohlubovat; Evropsk\u00e1 unie se bude v\u011bnovat jak podpo\u0159e ohro\u017een\u00fdch osob, tak p\u0159edch\u00e1zen\u00ed nez\u00e1konn\u00e9 migrace a postih\u016fm za obchodov\u00e1n\u00ed s\u00a0lidmi.<\/p>\n<p style=\"text-align: justify;\">V\u00a0p\u0159\u00edpad\u011b bezpe\u010dnosti je z\u00e1sadn\u00edm t\u00e9matem ji\u017e v\u00fd\u0161e zm\u00edn\u011bn\u00e1 kyberbezpe\u010dnost, kter\u00e1 se v\u00a0posledn\u00ed dob\u011b st\u00e1v\u00e1 st\u00e1le nal\u00e9hav\u011bj\u0161\u00edm probl\u00e9mem. Evropsk\u00e1 rada bude muset zaujmout postoj k\u00a0problematice sb\u011bru dat i jejich zneu\u017e\u00edv\u00e1n\u00ed. V\u00a0pozad\u00ed nez\u016fst\u00e1v\u00e1 ani probl\u00e9m terorismu.
