V\u00a0sou\u010dasnosti prob\u00edhaj\u00ed p\u0159\u00edstupov\u00e1 jedn\u00e1n\u00ed s\u00a0\u010cernou Horou, Srbskem, Tureckem a Islandem. Kandid\u00e1tsk\u00fd status m\u00e1 B\u00fdval\u00e1 jugosl\u00e1vsk\u00e1 republika Makedonie. Bosna a Herzegovina, Kosovo a Alb\u00e1nie maj\u00ed status potenci\u00e1ln\u00edch kandid\u00e1t\u016f.<\/li>\n<li>Od roku 2004 se p\u0159\u00edstupov\u00fd proces v\u00fdrazn\u011b prom\u011bnil. Po\u010det kapitol evropsk\u00e9ho pr\u00e1va, kter\u00e9 p\u0159istupuj\u00edc\u00ed st\u00e1ty mus\u00ed p\u0159evz\u00edt do n\u00e1rodn\u00edch pr\u00e1vn\u00edch \u0159\u00e1d\u016f a implementovat narostl z\u00a031 na 35. Kondicionalita EU pro vstup nov\u00fdch \u010dlensk\u00fdch st\u00e1t\u016f se v\u00fdrazn\u011b prom\u011bnila p\u0159ed p\u0159\u00edstupov\u00fdm procesem Chorvatska do EU. P\u0159ej\u00edm\u00e1n\u00ed accquis i jeho implementace je d\u016fsledn\u011bji kontrolov\u00e1na skrze syst\u00e9m otv\u00edrac\u00edch a uzav\u00edrac\u00edch m\u011b\u0159iteln\u00fdch c\u00edl\u016f, tzv. benchmark\u016f.<\/li>\n<li>V\u0161echny frakce v Evropsk\u00e9m parlamentu se v z\u00e1sad\u011b shoduj\u00ed na pokra\u010dov\u00e1n\u00ed roz\u0161i\u0159ov\u00e1n\u00ed EU i kdy\u017e jejich motivy se li\u0161\u00ed. Sporn\u00e1 z\u016fst\u00e1v\u00e1 ot\u00e1zka Turecka.<\/li>\n<\/ul>\n<h1 style=\"text-align: justify;\">\u00davod<\/h1>\n<p style=\"text-align: justify;\">P\u0159\u00edprava na vstup do Evropsk\u00e9 unie (EU) je relativn\u011b slo\u017eit\u00e1 procedura trvaj\u00edc\u00ed \u0159\u00e1dov\u011b roky. St\u00e1tu usiluj\u00edc\u00edmu o \u010dlenstv\u00ed v\u00a0EU m\u016f\u017ee b\u00fdt nejprve nab\u00eddnuta vyhl\u00eddka na \u010dlenstv\u00ed, co\u017e v\u00a0praxi znamen\u00e1 slib ud\u011blen\u00ed kandid\u00e1tsk\u00e9ho statusu ve chv\u00edli, kdy bude zem\u011b p\u0159ipraven\u00e1 na vstup. Kdy\u017e je z\u00e1jemce o \u010dlenstv\u00ed p\u0159ipraven ke vstupu do EU, doch\u00e1z\u00ed k\u00a0ud\u011blen\u00ed kandid\u00e1tsk\u00e9ho statutu. Pot\u00e9 kandid\u00e1tsk\u00e1 zem\u011b zahajuje form\u00e1ln\u00ed p\u0159\u00edstupov\u00e1 vyjedn\u00e1v\u00e1n\u00ed, kter\u00e1 vedou ke spln\u011bn\u00ed p\u0159\u00edstupov\u00fdch krit\u00e9ri\u00ed.<\/p>\n<p style=\"text-align: justify;\">\u017d\u00e1dost o vstup do EU m\u016f\u017ee podat kter\u00e1koli zem\u011b, kter\u00e1 spl\u0148uje podm\u00ednky \u010dlenstv\u00ed. Tato tzv. \u201ekoda\u0148sk\u00e1 krit\u00e9ria\u201c zahrnuj\u00ed tr\u017en\u00ed ekonomiku, stabiln\u00ed demokratick\u00fd syst\u00e9m, pr\u00e1vn\u00ed st\u00e1t, dodr\u017eov\u00e1n\u00ed lidsk\u00fdch pr\u00e1v, respekt a a ochranu men\u0161in a p\u0159ijet\u00ed ve\u0161ker\u00fdch pr\u00e1vn\u00edch p\u0159edpis\u016f EU, v\u010detn\u011b v\u00fdhledov\u00e9ho p\u0159ijet\u00ed eura.<a title=\"\" href=\"#_edn1\">[1]<\/a> Pr\u00e1vn\u00edm z\u00e1kladem t\u011bchto podm\u00ednek je \u010dl\u00e1nek 49 Smlouvy o EU, kter\u00e9 umo\u017e\u0148uje pod\u00e1n\u00ed \u017e\u00e1dosti o \u010dlenstv\u00ed ka\u017ed\u00e9mu evropsk\u00e9mu st\u00e1tu, kter\u00fd respektuje hodnoty EU (definov\u00e1ny \u010dl\u00e1nkem 2 Smlouvy o EU) a zav\u00e1\u017ee se k\u00a0jejich podpo\u0159e.<a title=\"\" href=\"#_edn2\">[2]<\/a><\/p>\n<p style=\"text-align: justify;\">Od roku 2004, kdy spole\u010dn\u011b s\u00a0dal\u0161\u00edmi dev\u00edti st\u00e1ty vstoupila \u010cesk\u00e1 republika, vrostl po\u010det \u010dlen\u016f EU na 28 st\u00e1t\u016f. Roz\u0161\u00ed\u0159en\u00ed roku 2004 bylo p\u00e1t\u00e9 v\u00a0po\u0159ad\u00ed. K\u00a0prvn\u00edmu lednu 1973 se uskute\u010dnilo historicky prvn\u00ed roz\u0161\u00ed\u0159en\u00ed EU, kdy se k\u00a0\u0161estici zakl\u00e1daj\u00edc\u00edch st\u00e1t\u016f (Francie, N\u011bmecko, It\u00e1lie, zem\u011b Beneluxu) p\u0159ipojila po dvou francouzsk\u00fdch vetech Velk\u00e1 Brit\u00e1nie spole\u010dn\u011b s\u00a0Irskem a D\u00e1nskem. N\u00e1sledovalo \u0158ecko ve druh\u00e9m kole v\u00a0roce 1981. Po p\u00e1du dikt\u00e1torsk\u00fdch re\u017eim\u016f ve \u0160pan\u011blsku a Portugalsku byla zah\u00e1jena a ukon\u010dena p\u0159\u00edstupov\u00e1 jedn\u00e1n\u00ed s\u00a0t\u011bmito zem\u011bmi, kter\u00e9 vstoupily do EU v\u00a01986. Po p\u00e1du \u017eelezn\u00e9 opony vstoupily t\u0159i neutr\u00e1ln\u00ed st\u00e1ty k roku 1995. EU se tak p\u0159ipojen\u00edm Rakouska, Finska a \u0160v\u00e9dska rozrostla na 15 st\u00e1t\u016f.<\/p>\n<p style=\"text-align: justify;\">P\u00e1t\u00e9 kolo roz\u0161\u00ed\u0159en\u00ed, v\u00a0r\u00e1mci n\u011bj\u017e vstoupila i \u010cesk\u00e1 republika, p\u0159edstavovalo unik\u00e1tn\u00ed v\u00fdzvu v\u00a0historii evropsk\u00e9 integrace. Obavy p\u0159ed rozkmit\u00e1n\u00edm institucion\u00e1ln\u00ed rovnov\u00e1hy Evropsk\u00fdch spole\u010denstv\u00ed a nutnost p\u0159\u00edprav vedly k\u00a0v\u00fdznamn\u011bj\u0161\u00ed reform\u011b prim\u00e1rn\u00edho pr\u00e1va Spole\u010denstv\u00ed, ne\u017e bylo zapot\u0159eb\u00ed kdy v\u00a0minulosti. Smlouva z\u00a0Nice, kter\u00e1 byla podeps\u00e1na v\u00a0roce 2001 roz\u0161\u00ed\u0159ila po\u010det poslanc\u016f Evropsk\u00e9ho parlamentu, omezila po\u010det komisa\u0159\u016f na jednoho pro ka\u017ed\u00fd \u010dlensk\u00fd st\u00e1t a doplnila pod\u0159\u00edzen\u00e9 soudy k\u00a0Soudn\u00edmu dvoru EU.<a title=\"\" href=\"#_edn3\">[3]<\/a> V\u00a0roce 2007 vstoupilo do EU Rumunsko a Bulharsko a v\u00a0roce 2013 Chorvatsko, jeho\u017e p\u0159\u00edstupov\u00fd proces se do zna\u010dn\u00e9 m\u00edry li\u0161il od t\u011bch p\u0159edchoz\u00edch (viz n\u00ed\u017ee).<\/p>\n<h1 style=\"text-align: justify;\">Z\u00e1kladn\u00ed aspekty politiky roz\u0161\u00ed\u0159en\u00ed<\/h1>\n<p style=\"text-align: justify;\">Od velk\u00e9ho roz\u0161\u00ed\u0159en\u00ed z\u00a0roku 2004 se p\u0159\u00edstupov\u00fd proces znateln\u011b prom\u011bnil. J\u00e1drem p\u0159\u00edstupov\u00e9ho procesu je transpozice a implementace evropsk\u00e9ho pr\u00e1va (acquis communautaire), kter\u00e9 je pro \u00fa\u010dely p\u0159\u00edstupov\u00e9ho procesu rozd\u011bleno do kapitol. Po\u010det t\u011bchto kapitol narostl z\u00a031 na 35. Summit v\u00a0Soluni zavedl nov\u00e9 podm\u00ednky pro kandid\u00e1tsk\u00e9 st\u00e1ty z\u00e1padn\u00edho Balk\u00e1nu, konkr\u00e9tn\u011b spolupr\u00e1ci s Mezin\u00e1rodn\u00edm trestn\u00edm tribun\u00e1l pro b\u00fdvalou Jugosl\u00e1vii a region\u00e1ln\u00ed spolupr\u00e1ci.<\/p>\n<h3 style=\"text-align: justify;\"><strong>P\u0159\u00edstupov\u00e9 rozhovory<\/strong><\/h3>\n<p style=\"text-align: justify;\">P\u0159ej\u00edm\u00e1n\u00ed acquis communautaire prob\u00edh\u00e1 p\u0159edev\u0161\u00edm b\u011bhem tzv. p\u0159\u00edstupov\u00fdch rozhovor\u016f, p\u0159\u00edpadn\u011b dodate\u010dn\u011b v\u00a0r\u00e1mci p\u0159echodn\u00e9ho obdob\u00ed po jejich uzav\u0159en\u00ed. Pojem \u201ep\u0159\u00edstupov\u00e9 rozhovory\u201c ozna\u010duje proces, v\u00a0jeho\u017e r\u00e1mci kandid\u00e1tsk\u00e1 zem\u011b vstupuje do Evropsk\u00e9 unie a p\u0159ej\u00edm\u00e1 a pln\u011b implementuje evropskou legislativu.<a title=\"\" href=\"#_edn4\">[4]<\/a> Nejde o \u201evyjedn\u00e1v\u00e1n\u00ed\u201c v\u00a0klasick\u00e9m slova smyslu, ale o proces nastaven\u00ed p\u0159istupuj\u00edc\u00ed zem\u011b na\u00a0pr\u00e1vn\u00ed, ekonomick\u00fd a soci\u00e1ln\u00ed syst\u00e9m EU.<a title=\"\" href=\"#_edn5\">[5]<\/a> Dal\u0161\u00ed slo\u017eka tohoto procesu je \u201einstitucion\u00e1ln\u00ed\u201c, pod n\u00ed\u017e spad\u00e1 vytv\u00e1\u0159en\u00ed kapacity pro efektivn\u00ed implementaci acquis.<\/p>\n<p style=\"text-align: justify;\">T\u011b\u017ei\u0161t\u011b vyjedn\u00e1vac\u00ed slo\u017eky t\u011bchto rozhovor\u016f tvo\u0159\u00ed sjedn\u00e1v\u00e1n\u00ed tzv. \u201ep\u0159echodn\u00fdch obdob\u00ed\u201c, o kter\u00e9 m\u016f\u017ee kandid\u00e1tsk\u00e1 zem\u011b za\u017e\u00e1dat. Tyto obdob\u00ed umo\u017en\u00ed p\u0159istupuj\u00edc\u00edmu st\u00e1tu ve specifick\u00e9 oblasti dokon\u010dit harmonizaci n\u00e1rodn\u00ed legislativy s\u00a0acquis a\u017e po vstupu do EU (v praxi se jedn\u00e1 nap\u0159\u00edklad sm\u011brnice, jejich\u017e implementace je zvl\u00e1\u0161t\u011b n\u00e1ro\u010dn\u00e1 na investice).<a title=\"\" href=\"#_edn6\">[6]<\/a> P\u0159echodn\u00e1 obdob\u00ed jsou ud\u011blena pouze v\u00a0p\u0159\u00edpad\u011b p\u0159edlo\u017een\u00ed realistick\u00fdch implementa\u010dn\u00edch pl\u00e1n\u016f, kter\u00e9 specifikuj\u00ed kroky, kter\u00e9 p\u0159istupuj\u00edc\u00ed zem\u011b podnikne pro zaji\u0161t\u011bn\u00ed pln\u00e9 shody s\u00a0c\u00edlovou legislativou do konce p\u0159echodn\u00e9ho obdob\u00ed.<a title=\"\" href=\"#_edn7\">[7]<\/a> P\u0159echodn\u00e1 obdob\u00ed jsou sjedn\u00e1v\u00e1na i v z\u00e1jmu EU a to typicky v\u00a0oblastech p\u0159\u00edstupu zbo\u017e\u00ed, pracovn\u00edk\u016f, kapit\u00e1lu \u010di slu\u017eeb na jednotn\u00fd vnit\u0159n\u00ed trh EU.<a title=\"\" href=\"#_edn8\">[8]<\/a><\/p>\n<p style=\"text-align: justify;\">V\u00a0prvn\u00ed etap\u011b p\u0159\u00edstupov\u00fdch jedn\u00e1n\u00ed je spu\u0161t\u011bn tzv. \u201escreening\u201c, kter\u00fd za EU prov\u00e1d\u00ed Evropsk\u00e1 komise. \u00da\u010delem screeningu je zanalyzovat a zhodnotit stupe\u0148 harmonizace n\u00e1rodn\u00ed legislativy s\u00a0acquis a p\u0159edev\u0161\u00edm odhalit rozd\u00edly v\u00a0ka\u017ed\u00e9 kapitole. V\u00a0tomto procesu je ka\u017ed\u00e1 kapitola zpracov\u00e1v\u00e1na samostatn\u011b. V\u00a0z\u00e1vislosti na mno\u017estv\u00ed acquis m\u016f\u017ee zpracov\u00e1n\u00ed jedn\u00e9 kapitoly trvat od jednoho dne a\u017e po n\u011bkolik t\u00fddn\u016f, zat\u00edmco cel\u00fd proces pro v\u0161echny kapitoly dohromady zabere p\u0159ibli\u017en\u011b jeden rok. <a title=\"\" href=\"#_edn9\">[9]<\/a> Po dokon\u010den\u00ed anal\u00fdzy Evropsk\u00e1 komise p\u0159ed\u00e1v\u00e1 vypracovanou zpr\u00e1vu o screeningu \u010dlensk\u00fdm st\u00e1t\u016fm, kter\u00e1 obsahuje i doporu\u010den\u00ed Komise k\u00a0otev\u0159en\u00ed kapitol.<\/p>\n<p style=\"text-align: justify;\">Specificky v\u00a0chorvatsk\u00e9m p\u0159\u00edpad\u011b se Komise vyjad\u0159ovala i pro stanoven\u00ed tzv. \u201eotev\u00edrac\u00edch benchmark\u016f\u201c. Tyto nov\u00e9 a kl\u00ed\u010dov\u00e9 n\u00e1stroje obsahuj\u00ed ur\u010dit\u00e9 m\u011b\u0159iteln\u00e9 podm\u00ednky a c\u00edle (nap\u0159. schv\u00e1len\u00ed nov\u00fdch z\u00e1kon\u016f, strategi\u00ed nebo spln\u011bn\u00ed z\u00e1vazk\u016f vypl\u00fdvaj\u00edc\u00edch z\u00a0Dohody a p\u0159idru\u017een\u00ed a spolupr\u00e1ci), kter\u00e9 Chorvatsko muselo splnit je\u0161t\u011b p\u0159ed otev\u0159en\u00edm konkr\u00e9tn\u00ed kapitoly. Podobn\u011b tzv. \u201euzav\u00edrac\u00ed benchmarky\u201c obsahuj\u00ed podm\u00ednky, kter\u00e9 je t\u0159eba splnit p\u0159ed uzav\u0159en\u00edm kapitoly. Tento postup Evropsk\u00e1 komise uplat\u0148uje, pokud jsou rozd\u00edly mezi unijn\u00ed a n\u00e1rodn\u00ed \u00fapravou zvl\u00e1\u0161t\u011b v\u00fdrazn\u00e9. Alespo\u0148 jeden otev\u00edrac\u00ed benchmark byl stanoven v\u00a011 kapitol\u00e1ch, uzav\u00edrac\u00ed benchmarky muselo Chorvatsko splnit ve v\u0161ech kapitol\u00e1ch krom\u011b \u010dty\u0159 m\u00e9n\u011b obt\u00ed\u017en\u00fdch a technick\u00fdch kapitol (v\u011bda a v\u00fdzkum, vzd\u011bl\u00e1v\u00e1n\u00ed a kultura, instituce a dal\u0161\u00ed ot\u00e1zky).<a title=\"\" href=\"#_edn10\">[10]<\/a><\/p>\n<p style=\"text-align: justify;\">Po screeningu p\u0159eb\u00edr\u00e1 vyjedn\u00e1v\u00e1n\u00ed Rada EU, kter\u00e1 na z\u00e1klad\u011b doporu\u010den\u00ed Komise rozhoduje o otev\u0159en\u00ed jednotliv\u00fdch kapitol, p\u0159\u00edpadn\u011b stanoven\u00ed \u201eotev\u00edrac\u00edch benchmark\u016f\u201c. T\u011b\u017ei\u0161t\u011b cel\u00e9ho procesu le\u017e\u00ed ve f\u00e1zi po otev\u0159en\u00ed kapitoly, kde Rada jednala s chorvatskou stranou o podm\u00ednk\u00e1ch implementace acquis v\u010detn\u011b d\u016fle\u017eit\u00fdch p\u0159echodn\u00fdch obdob\u00ed. Po dosa\u017een\u00ed shody mezi EU a kandid\u00e1tskou zem\u00ed a po spln\u011bn\u00ed \u201euzav\u00edrac\u00edch benchmark\u016f\u201c m\u016f\u017ee b\u00fdt kapitola provizorn\u011b uzav\u0159ena (v p\u0159\u00edpad\u011b nedostate\u010dn\u00e9ho pln\u011bn\u00ed j\u00ed lze znovu otev\u0159\u00edt). Form\u00e1ln\u00ed rozhodnut\u00ed je vyd\u00e1no na mezivl\u00e1dn\u00ed konferenci na ministersk\u00e9 \u00farovni. Ve chv\u00edli kdy jsou v\u0161echny kapitoly uzav\u0159eny, Evropsk\u00e1 rada form\u00e1ln\u011b ukon\u010duje vyjedn\u00e1vac\u00ed proces, jeho\u017e v\u00fdsledky jsou pot\u00e9 z\u00e1stupci \u010dlensk\u00fdch st\u00e1t\u016f, instituc\u00ed EU a z\u00e1stupci kandid\u00e1tsk\u00e9 zem\u011b spole\u010dn\u011b za\u010dlen\u011bny do n\u00e1vrhu p\u0159\u00edstupov\u00e9 smlouvy.<a title=\"\" href=\"#_edn11\">[11]<\/a><\/p>\n<p style=\"text-align: justify;\">V\u00fdsledkem rozhovor\u016f je tedy implementace acquis kandid\u00e1tskou zem\u00ed a vytvo\u0159en\u00ed mezin\u00e1rodn\u00ed smlouvy mezi \u010dlensk\u00fdmi st\u00e1ty Evropsk\u00e9 unie a kandid\u00e1tskou zem\u00ed, kter\u00e1 stvrzuje akt vstupu kandid\u00e1tsk\u00e9 zem\u011b do EU a obsahuje v\u0161echna p\u0159echodn\u00e1 obdob\u00ed, kter\u00e1 si kandid\u00e1tsk\u00e1 zem\u011b dok\u00e1zala vyjednat.<a title=\"\" href=\"#_edn12\">[12]<\/a> Kandid\u00e1tsk\u00e1 zem\u011b je pova\u017eov\u00e1na za p\u0159istupuj\u00edc\u00ed zemi a\u017e ve chv\u00edli, kdy Komise zve\u0159ejn\u00ed z\u00e1v\u011bre\u010dn\u00fd posudek, Evropsk\u00fd parlament podpo\u0159\u00ed p\u0159\u00edstupovou smlouvu a Evropsk\u00e1 rada se jednohlasn\u011b shodne na p\u0159ijet\u00ed nov\u00e9ho st\u00e1tu do EU. P\u0159\u00edstupov\u00e1 smlouva smlouva pot\u00e9 vstupuje do ratifika\u010dn\u00ed procedury, b\u011bhem kter\u00e9 j\u00ed mus\u00ed podpo\u0159it parlamenty p\u0159istupuj\u00edc\u00ed zem\u011b a v\u0161ech \u010dlensk\u00fdch st\u00e1t\u016f EU.<a title=\"\" href=\"#_edn13\">[13]<\/a> V\u011bt\u0161ina p\u0159istupuj\u00edc\u00edch zem\u00ed d\u00e1le organizuje dom\u00e1c\u00ed referendum o vstupu do EU. P\u0159istupuj\u00edc\u00ed zem\u011b se st\u00e1v\u00e1 \u010dlenem EU k\u00a0p\u0159edem ur\u010den\u00e9mu datu, pod podm\u00ednkou dokon\u010den\u00ed ratifika\u010dn\u00edho procesu.<a title=\"\" href=\"#_edn14\">[14]<\/a> P\u0159istupuj\u00edc\u00ed zem\u011b rovn\u011b\u017e z\u00edsk\u00e1v\u00e1 status aktivn\u00edho pozorovatele, kter\u00fd ji umo\u017e\u0148uje \u00fa\u010dastnit se zased\u00e1n\u00ed v\u011bt\u0161iny pracovn\u00edch skupin v\u00a0Rad\u011b EU i ve v\u00fdborech Evropsk\u00e9 komise.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Institucion\u00e1ln\u00ed struktura vyjedn\u00e1vac\u00edho procesu<\/strong><\/h3>\n<p style=\"text-align: justify;\">P\u0159\u00edstupov\u00e1 jedn\u00e1n\u00ed mezi \u010dlensk\u00fdmi st\u00e1ty EU a nov\u011b p\u0159istupuj\u00edc\u00edm st\u00e1tem prob\u00edhaj\u00ed v\u00a0r\u00e1mci bilater\u00e1ln\u00edch konferenc\u00ed, kter\u00fdch se \u00fa\u010dastn\u00ed i z\u00e1stupci Komise. Unijn\u00ed vyjedn\u00e1vac\u00ed pozici prezentuje p\u0159edsednictv\u00ed Rady Evropsk\u00e9 unie. Tyto konference se odehr\u00e1vaj\u00ed na dvou \u00farovn\u00edch: na ministersk\u00e9 \u00farovni neboli \u00farovni hlav delegac\u00ed (obvykle minist\u0159i zahrani\u010d\u00ed) a na \u00farovni z\u00e1stupc\u016f (st\u00e1l\u00ed z\u00e1stupci \u010dlensk\u00fdch st\u00e1t\u016f p\u0159i EU na stran\u011b \u010dlensk\u00fdch st\u00e1t\u016f, hlavn\u00ed vyjednava\u010d na stran\u011b p\u0159istupuj\u00edc\u00edho st\u00e1tu). Mezivl\u00e1dn\u00ed konference na ministersk\u00e9 \u00farovni se kon\u00e1 dvakr\u00e1t do roka, na \u00farovni z\u00e1stupc\u016f dle pot\u0159eby.<a title=\"\" href=\"#_edn15\">[15]<\/a><\/p>\n<p style=\"text-align: justify;\">V\u00a0Chorvatsk\u00e9m p\u0159\u00edpad\u011b m\u011bl vyjedn\u00e1vac\u00ed t\u00fdm celkem p\u0159es t\u0159i tis\u00edce \u010dlen\u016f, kte\u0159\u00ed vypracovali p\u0159es dv\u011b st\u011b tis\u00edc str\u00e1nek ofici\u00e1ln\u00edch dokument\u016f.<a title=\"\" href=\"#_edn16\">[16]<\/a> Tato \u010d\u00edsla ale demonstruj\u00ed unik\u00e1tn\u00ed n\u00e1ro\u010dnost chorvatsk\u00e9ho procesu, kter\u00e1 byla zp\u016fsobena hlavn\u011b syst\u00e9mem \u201ebenchmark\u016f\u201c, kter\u00fd byl pln\u011b zaveden a\u017e b\u011bhem vstupu Chorvatska.<\/p>\n<p style=\"text-align: justify;\">Vyjedn\u00e1vac\u00ed pozice EU a kandid\u00e1tsk\u00e9 zem\u011b jsou p\u0159ipravov\u00e1ny individu\u00e1ln\u011b pro ka\u017edou kapitolu, v\u00fdsledky screeningu slou\u017e\u00ed jako podklady. Jako prvn\u00ed prezentuj\u00ed svou pozici kandid\u00e1tsk\u00e9 zem\u011b. Ta mus\u00ed konkretizovat pl\u00e1n a zp\u016fsob implementace acquis spole\u010dn\u011b s\u00a0popisem institucion\u00e1ln\u00edch kapacit kandid\u00e1tsk\u00e9 zem\u011b. Pot\u00e9 co pozici p\u0159iprav\u00ed vyjedn\u00e1vac\u00ed t\u00fdm spole\u010dn\u011b s\u00a0pracovn\u00edmi skupinami a n\u00e1sledn\u011b ji schv\u00e1l\u00ed vl\u00e1da, putuje pozice skrze sekretari\u00e1t mezivl\u00e1dn\u00ed konference do EU. N\u00e1vrh spole\u010dn\u00e9 pozice Evropsk\u00e9 unie zpracov\u00e1v\u00e1 Komise, potom j\u00ed diskutuj\u00ed pracovn\u00ed skupiny Rady Evropsk\u00e9 unie a v\u00fdbor st\u00e1l\u00fdch z\u00e1stupc\u016f COREPER. Po jej\u00edm schv\u00e1len\u00ed je na mezivl\u00e1dn\u00ed konferenci kapitola otev\u0159ena. Evropsk\u00e1 komise dohl\u00ed\u017e\u00ed na pln\u011bn\u00ed uzav\u00edrac\u00edch benchmark\u016f a jej\u00ed zpr\u00e1vy jsou podkladem pro Radu, kter\u00e1 m\u016f\u017ee p\u0159ijmout n\u00e1vrh z\u00e1v\u011bre\u010dn\u00e9 spole\u010dn\u00e9 pozice. Na mezivl\u00e1dn\u00ed konferenci je pak kapitola form\u00e1ln\u011b provizorn\u011b uzav\u0159ena. Evropsk\u00fd parlament je pravideln\u011b informov\u00e1n o pr\u016fb\u011bhu jedn\u00e1n\u00ed.<a title=\"\" href=\"#_edn17\">[17]<\/a><\/p>\n<p style=\"text-align: justify;\">Existuje \u0159ada okolnost\u00ed, kter\u00e9 p\u0159isp\u00edvaj\u00ed k\u00a0jevu, kter\u00fd je ozna\u010dov\u00e1n jako \u201e\u00fanava z\u00a0roz\u0161\u00ed\u0159en\u00ed\u201c. Vy\u0161\u0161\u00ed po\u010det \u010dlen\u016f EU n\u00e1sob\u00ed potenci\u00e1ln\u00ed bilater\u00e1ln\u00ed neshody mezi \u010dlensk\u00fdmi zem\u011bmi a p\u0159istupuj\u00edc\u00edmi st\u00e1ty. \u0160patn\u00e1 ekonomick\u00e1 situace v\u00a0euroz\u00f3n\u011b d\u00e1le p\u0159i\u017eivuje nechu\u0165 ob\u010dan\u016f EU k\u00a0roz\u0161i\u0159ov\u00e1n\u00ed Unie. A zrcadlov\u011b se \u201e\u00fanava z\u00a0roz\u0161\u00ed\u0159en\u00ed\u201c projevuje i u kandid\u00e1tsk\u00fdch zem\u00ed \u2013 \u010d\u00edm v\u00edce se bl\u00ed\u017e\u00ed vstupu do EU, t\u00edm rychleji kles\u00e1 podpora obyvatel pro vstup. EU se sna\u017e\u00ed balancovat nep\u0159\u00edzniv\u00fd v\u00fdvoj ve\u0159ejn\u00e9ho m\u00edn\u011bn\u00ed v\u00a0kandid\u00e1tsk\u00fdch zem\u00ed pravidelnou nab\u00eddkou \u201eodm\u011bn\u201c, nap\u0159\u00edklad v\u00a0Srbsku spu\u0161t\u011bn\u00ed liberalizace v\u00edzov\u00e9ho re\u017eimu dostalo v\u00a0roce 2009 podporu \u010dlenstv\u00ed v\u00a0EU na rekordn\u00edch 73 %. V\u00a0sou\u010dasnosti ale u\u017e op\u011bt spadla ke 40 %. <a title=\"\" href=\"#_edn18\">[18]<\/a> Zat\u00edmco r\u00e9torika deklarac\u00ed p\u0159ed velk\u00fdm roz\u0161\u00ed\u0159en\u00edm roku 2004 v\u00a0podstat\u011b zav\u00e1zala \u010dlensk\u00e9 zem\u011b k\u00a0p\u0159ijet\u00ed nov\u00fdch st\u00e1t\u016f, v\u00a0p\u0159\u00edpad\u011b z\u00e1padn\u00edho Balk\u00e1nu je EU mnohem opatrn\u011bj\u0161\u00ed a v\u00fdslovn\u011b zd\u016fraz\u0148uje, \u017ee \u201ev\u00fdsledky p\u0159\u00edstupov\u00fdch nelze p\u0159edem garantovat\u201c, co\u017e d\u00e1le p\u0159isp\u00edv\u00e1 k\u00a0v\u00fd\u0161e popsan\u00e9mu fenom\u00e9nu. <a title=\"\" href=\"#_edn19\">[19]<\/a><\/p>\n<h1 style=\"text-align: justify;\">Sou\u010dasn\u00fd stav politiky roz\u0161\u00ed\u0159en\u00ed<\/h1>\n<p style=\"text-align: justify;\">Region z\u00e1padn\u00edho Balk\u00e1nu se v mnoh\u00e9m li\u0161\u00ed od st\u0159edn\u00ed Evropy, co\u017e je jednou z p\u0159\u00ed\u010din heterogenn\u00edho p\u0159\u00edstupu EU k\u00a0zem\u00edm regionu. Stabilita jednotliv\u00fdch zem\u00ed se na rozd\u00edl od st\u0159edn\u00ed Evropy dramaticky li\u0161\u00ed a proto m\u016f\u017eeme pozorovat individu\u00e1ln\u00ed p\u0159\u00edstup EU na rozd\u00edl od skupinov\u00e9ho p\u0159\u00edstupu, kter\u00e9ho jsme byli sv\u011bdky v\u00a0p\u0159\u00edpad\u011b velk\u00e9ho roz\u0161\u00ed\u0159en\u00ed roku 2004. St\u00e1ty z\u00e1padn\u00edho Balk\u00e1nu jsou na rozd\u00edl od st\u00e1t\u016f VP, kter\u00e9 maj\u00ed pozemn\u00ed a mo\u0159sk\u00e9 hranice s\u00a0Ruskou federac\u00ed, obklopeny \u010dlensk\u00fdmi st\u00e1ty EU, co\u017e p\u0159isp\u00edv\u00e1 k\u00a0prioritizaci jejich vstupu ze strany EU. P\u0159esto\u017ee je region z\u00e1padn\u00edho Balk\u00e1nu zat\u00ed\u017een n\u011bkolika zmra\u017een\u00fdmi konflikty (Makedonie, Kosovo, Bosna a Herzegovina), perspektiva t\u011bchto st\u00e1t\u016f je st\u00e1le mnohem v\u00edce naklon\u011bna jejich vstupu ne\u017e je tomu u st\u00e1t\u016f VP. Summit v\u00a0Soluni, kter\u00fd se uskute\u010dnil v\u00a0\u010dervnu roku 2003,\u00a0 potvrdil statuty kandid\u00e1t\u016f \u010di potenci\u00e1ln\u00edch kandid\u00e1t\u016f pro Alb\u00e1nii, Bosnu a Herzegovinu, B\u00fdvalou jugosl\u00e1vskou republiku Makedonii, Chorvatsko, \u010cernou Horu a Srbsko.<a title=\"\" href=\"#_edn20\">[20]<\/a><\/p>\n<p style=\"text-align: justify;\"><b>Alb\u00e1nie<\/b><\/p>\n<p style=\"text-align: justify;\">Stejn\u011b jako ostatn\u00ed st\u00e1ty z\u00e1padn\u00edho Balk\u00e1nu z\u00edskala Alb\u00e1nie v roce 2003 status potenci\u00e1ln\u00edho kandid\u00e1ta. V roce 2012 doporu\u010dila Komise ud\u011blen\u00ed kandid\u00e1tsk\u00e9ho statutu d\u00edky proveden\u00ed reforem, vedouc\u00edm ke spln\u011bn\u00ed hlavn\u00edch z evropsk\u00fdch krit\u00e9ri\u00ed. N\u011bkter\u00e9 \u010dlensk\u00e9 st\u00e1ty v\u0161ak odm\u00edtly schv\u00e1lit ud\u011blen\u00ed kandid\u00e1tsk\u00e9ho statutu Alb\u00e1nii a rozhodnut\u00ed o ud\u011blen\u00ed statutu bylo odlo\u017eeno na \u010derven 2014. V sou\u010dasnosti je kladen d\u016fraz na udr\u017een\u00ed proveden\u00fdch reforem v praxi a pokra\u010dov\u00e1n\u00ed reformn\u00edho procesu v dal\u0161\u00edch oblastech, p\u0159edev\u0161\u00edm v oblasti jurisdikce a administrativy.<a title=\"\" href=\"#_edn21\">[21]<\/a><\/p>\n<p style=\"text-align: justify;\"><b>Bosna a Hercegovina<\/b><\/p>\n<p style=\"text-align: justify;\">V roce 2003 byl Bosn\u011b a Hercegovin\u011b ud\u011blen status potenci\u00e1ln\u00ed kandid\u00e1tsk\u00e9 zem\u011b. V sou\u010dasn\u00e9 dob\u011b v\u0161ak v zemi p\u0159etrv\u00e1v\u00e1 mnoho politick\u00fdch i struktur\u00e1ln\u00edch probl\u00e9m\u016f a proto se tamn\u00ed politick\u00e9 elity v sou\u010dasnosti soust\u0159ed\u00ed p\u0159edev\u0161\u00edm na prov\u00e1d\u011bn\u00ed reforem pro zlep\u0161en\u00ed \u017eivotn\u00ed \u00farovn\u011b v zemi. EU spolupracuje s Bosnou a Hercegovinou mimo jin\u00e9 skrze speci\u00e1ln\u00edho reprezentanta EU, misi EUFOR\/Althea nebo v r\u00e1mci Spole\u010dn\u00e9 zahrani\u010dn\u00ed a bezpe\u010dnostn\u00ed politiky EU. Od roku 2010 tak\u00e9 ob\u010dan\u00e9 Bosny a Hercegoviny z\u00edskali bezv\u00edzov\u00fd p\u0159\u00edstup do zem\u00ed EU.<a title=\"\" href=\"#_edn22\">[22]<\/a><\/p>\n<p style=\"text-align: justify;\"><b>B\u00fdval\u00e1 jugosl\u00e1vsk\u00e1 republika Makedonie<\/b><\/p>\n<p style=\"text-align: justify;\">Mezi kandid\u00e1tsk\u00e9 zem\u011b EU se B\u00fdval\u00e1 jugosl\u00e1vsk\u00e1 republika Makedonie (FYROM) za\u0159adila v roce 2005. U\u017e od roku 2009 doporu\u010duje Komise otev\u0159en\u00ed p\u0159\u00edstupov\u00fdch jedn\u00e1n\u00ed, zat\u00edm k tomu v\u0161ak nedo\u0161lo. Z\u00e1sadn\u00edm probl\u00e9mem je nesouhlas \u0158ecka, kter\u00e9mu vad\u00ed ofici\u00e1ln\u00ed n\u00e1zev st\u00e1tu \u201eMakedonsk\u00e1 republika\u201c, proto\u017ee se ob\u00e1v\u00e1 mo\u017en\u00fdch nacionalistick\u00fdch tendenc\u00ed, ohro\u017euj\u00edc\u00edch teritori\u00e1ln\u00ed jednotu \u0158ecka. Historick\u00fd region Makedonie se toti\u017e nal\u00e9z\u00e1 tak\u00e9 v severn\u00ed \u010d\u00e1sti \u0159eck\u00e9ho st\u00e1tu. P\u0159ipravovan\u00fdm \u0159e\u0161en\u00edm je zm\u011bna ofici\u00e1ln\u00edho n\u00e1zvu zem\u011b.<a title=\"\" href=\"#_edn23\">[23]<\/a><\/p>\n<p style=\"text-align: justify;\"><b>\u010cern\u00e1 Hora<\/b><\/p>\n<p style=\"text-align: justify;\">Samostatn\u00fd st\u00e1t \u010cern\u00e1 Hora vznikl v roce 2006 odtr\u017een\u00edm od Srbska. U\u017e v roce 2008 podala \u010cern\u00e1 Hora p\u0159ihl\u00e1\u0161ku do EU a od roku 2010 je kandid\u00e1tskou zem\u00ed. P\u0159\u00edstupov\u00e9 rozhovory prob\u00edhaj\u00ed od roku 2012. A\u010dkoliv zem\u011b nen\u00ed \u010dlenem EU ani euroz\u00f3ny, jednostrann\u011b vyhl\u00e1sila euro jako svou m\u011bnu v\u00a0roce 2002.<a title=\"\" href=\"#_edn24\">[24]<\/a><\/p>\n<p style=\"text-align: justify;\"><b>Island<\/b><\/p>\n<p style=\"text-align: justify;\">Island se funk\u010dn\u011b p\u0159ibl\u00ed\u017eil struktur\u00e1m EU skrze \u010dlenstv\u00ed v Evropsk\u00e9m hospod\u00e1\u0159sk\u00fd prostoru, Schengensk\u00e9m prostoru nebo Evropsk\u00e9m sdru\u017een\u00ed voln\u00e9ho obchodu a v NATO. P\u0159\u00edstupov\u00e1 jedn\u00e1n\u00ed byla otev\u0159ena v roce 2010, od roku 2013 jsou v\u0161ak pozastavena z rozhodnut\u00ed islandsk\u00e9 vl\u00e1dy. Pro Island je tradi\u010dn\u00edm st\u00e1tn\u00edm p\u0159\u00edjmem rybolov odpor k jeho regulaci ze strany EU se stal jedn\u00edm z d\u016fvod\u016f, pro\u010d ve volb\u00e1ch zv\u00edt\u011bzily euroskeptick\u00e9 strany.<a title=\"\" href=\"#_edn25\">[25]<\/a><\/p>\n<p style=\"text-align: justify;\"><b>Kosovo<\/b><\/p>\n<p style=\"text-align: justify;\">Tato zem\u011b je v\u011bt\u0161inou demokratick\u00fdch st\u00e1t\u016f uzn\u00e1v\u00e1na jako autonomn\u00ed st\u00e1t, nicm\u00e9n\u011b republika Srbsko si ho n\u00e1rokuje jako svou autonomn\u00ed republiku. Situace v Kosovu zat\u00edm nen\u00ed zcela stabilizovan\u00e1, v zemi st\u00e1le p\u016fsob\u00ed jednotky KFOR a tak\u00e9 mise EULEX, kter\u00e1 zde p\u0159isp\u00edv\u00e1 k budov\u00e1n\u00ed pr\u00e1vn\u00edho st\u00e1tu. Evropsk\u00e1 Unie tak\u00e9 ustavila \u00fa\u0159ad speci\u00e1ln\u00edho reprezentanta EU pro Kosovo a kosovskou Mezin\u00e1rodn\u00ed civiln\u00ed kancel\u00e1\u0159. Republika je v sou\u010dasnosti potenci\u00e1ln\u00edm kandid\u00e1tem na \u010dlenstv\u00ed v EU.<a title=\"\" href=\"#_edn26\">[26]<\/a><\/p>\n<p style=\"text-align: justify;\"><b>Srbsko<\/b><\/p>\n<p style=\"text-align: justify;\">Od roku 2003 bylo Srbsko ozna\u010deno za potenci\u00e1ln\u00edho kandid\u00e1ta a roku 2009 zem\u011b ofici\u00e1ln\u011b za\u017e\u00e1dala o \u010dlenstv\u00ed v EU na z\u00e1klad\u011b programu Evropsk\u00e9 partnerstv\u00ed pro Srbsko. O \u010dty\u0159i roky pozd\u011bji dostalo Srbsko statut kandid\u00e1tsk\u00e9 zem\u011b a v lednu 2014 za\u010dala prvn\u00ed p\u0159\u00edstupov\u00e1 jedn\u00e1n\u00ed. Pro hladk\u00fd pr\u016fb\u011bh jedn\u00e1n\u00ed je pro Srbsko pot\u0159eba dos\u00e1hnout dohody v ot\u00e1zce Kosova. Proces v minulosti tak\u00e9 zt\u011b\u017eovaly neshody s Rumunskem a politick\u00e1 ot\u00e1zka dopaden\u00ed Ratko Mladi\u0107e.<a title=\"\" href=\"#_edn27\">[27]<\/a><\/p>\n<p style=\"text-align: justify;\"><b>Turecko<\/b><\/p>\n<p style=\"text-align: justify;\">A\u010dkoliv je Turecko u\u017e od roku 1963 propojeno s Evropsk\u00fdm hospod\u00e1\u0159sk\u00fdm spole\u010denstv\u00edm a pod\u00e1n\u00ed p\u0159ihl\u00e1\u0161ky do EU prob\u011bhlo ji\u017e v roce 1987, z\u00edskalo Turecko kandid\u00e1tsk\u00fd status a\u017e na konci 90. let. V roce 2005 za\u010dala p\u0159\u00edstupov\u00e1 jedn\u00e1n\u00ed, probl\u00e9mem nicm\u00e9n\u011b z\u016fst\u00e1v\u00e1 schv\u00e1len\u00ed p\u0159\u00eddavn\u00e9ho protokolu Ankarsk\u00e9 asocia\u010dn\u00ed dohody o ot\u00e1zce Kypru v Turecku. EU proto zat\u00edm odm\u00edt\u00e1 provizorn\u011b uzav\u0159\u00edt jakoukoliv z projedn\u00e1van\u00fdch kapitol. Dal\u0161\u00edm probl\u00e9mem z\u016fst\u00e1vaj\u00ed nap\u0159\u00edklad rozd\u00edly mezi st\u00e1tn\u00edm z\u0159\u00edzen\u00edm v Turecku a ve \u010dlensk\u00fdch st\u00e1tech EU nebo dodr\u017eov\u00e1n\u00ed lidsk\u00fdch pr\u00e1v v zemi.<a title=\"\" href=\"#_edn28\">[28]<\/a><\/p>\n<p style=\"text-align: justify;\"><b>Ukrajina<\/b><\/p>\n<p style=\"text-align: justify;\">V\u00a0sou\u010dasnosti Ukrajina nem\u00e1 status kandid\u00e1ta ani potenci\u00e1ln\u00edho kandid\u00e1ta. Diskuze o \u010dlenstv\u00ed Ukrajiny v\u00a0EU prov\u00e1z\u00ed od po\u010d\u00e1tku r\u00e9torika nep\u0159ipravenosti. Nejv\u00fdsti\u017en\u011bji situaci shrnul Jos\u00e9 Manuel Barroso v\u00a0roce 2006: \u201eUkrajina nen\u00ed p\u0159ipraven\u00e1 a my nejsme p\u0159ipraveni.\u201c<a title=\"\" href=\"#_edn29\">[29]<\/a> Stav justice a lidsk\u00fdch, ob\u010dansk\u00fdch a politick\u00fdch pr\u00e1v byl a\u017e do dramatick\u00fdch zm\u011bn na po\u010d\u00e1tku roku 2014 kl\u00ed\u010dovou p\u0159ek\u00e1\u017ekou \u010dlenstv\u00ed t\u00e9to zem\u011b v\u00a0EU. V\u00a0roce 2013 na summitu EU-Ukrajina na Jalt\u011b formulovali z\u00e1stupci EU jako hlavn\u00ed p\u0159ek\u00e1\u017eku politicky motivovan\u00e9 v\u011bzn\u011bn\u00ed b\u00fdval\u00e9 premi\u00e9rky Ukrajiny Julie Tymo\u0161enkov\u00e9. Ta v\u0161ak byla propu\u0161t\u011bna v\u00a0\u00fanoru 2014 po odstoupen\u00ed vl\u00e1dy premi\u00e9ra Azarova.
